TOPO GURU SUBSCRIPTION GIVEAWAY GENERAL TERMS AND CONDITIONS

1. General information and conditions for participation

1.1 The Promoter of the giveaway ("Giveaway"), organized on the Topo Guru (TG) Facebook page is Topo Guru Kft. (registered office: 1032 Budapest, Kiscelli utca 33. 3. em. 2) ("Promoter").
1.2 Promoter is posting the Giveaway on TG website (www.topoguru.com) ("Post").
1.2.1 Entries can be eligible for the prizes only in case of validly fulfilling all terms and conditions of the Giveaway.
The Promoter is entitled to verify the validity of the applications.
1.2.2 Entrants must subscribe to Topo Guru’s mobile app in monthly, quarterly or yearly subscription during the time period indicated in the post published by Promoter. Entrants can participate in the Giveaway during the indicated time period by having a subscription.

1.3 The winners agree to the use of his/her name in any publicity material on Promoter’s Facebook and Instagram pages.
1.4 The Giveaway is open to those natural persons with legal capacity, aged 16 years or over who are residents of the European Union, or EU citizens having a valid identity card issued by an EU country ("Entrants") and who:

• subscribed to Topo Guru mobile application (Android or iOS) during the period of the Giveaway
• did not cancel his/her subscription within 8 days after the subscription
• agrees that Promoter will handle the data provided (full name, Facebook ID / Instagram ID) and later - in case of winning - the necessary data (address, telephone number, email address) - in accordance with current EU data protection legislation, and
• by entering into the Giveaway accepts all points of the terms and conditions ("Terms and conditions")(hereinafter together: "Giveaway")

1.5 During the duration of the Giveaway, an Entrant is only entitled to participate with one subscription (unless Promoter provides otherwise in the given Post).
1.6 TG members with active subscription can participate in the Giveaway if they upgrade to a bigger subscription package during the period of the Giveaway. TG members having a yearly subscription can participate without any additional subscription, but only in case they contact Promoters during the period of the Giveaway on the following email address: [email protected]
1.7 Promoter may exclude entrants who provide false information from the given Giveaway.
1.8 Promoter only considers valid subscriptions initiated by the entrants in a self-registered Topo Guru profile. If the Entrant uses a Facebook/Google/Apple profile not signed up by him/her for registration in the TG app, all liability of the Promoter and Data processor in connection with the Giveaway arising from the right to use the Facebook/Google/Apple profile is excluded.
1.9 Entrants with a subscription will be examined by Promoter in order to meet the terms and conditions, and if Entrant does not comply with the Giveaway terms and conditions for any reason, the Entrant concerned may be excluded from the given Giveaway.
1.10 Entrants who, contrary to the spirit of the Giveaway, participate in a team under the name of a natural person with an unrealistic profile, with the aim of increasing their chances of winning by this deceptive behavior, may be disqualified from the Giveaway, at the discretion of the Promoter. Participants or Entrants who engage in unfair conduct as defined in this section shall be liable for any damages caused to the Promoter in connection with the Giveaway.

2. Giveaway period

2.1 Giveaway starts on 27 August 2020 and ends on 10 September 2020.

3. Winners

3.1 Winners will be chosen at random by software, from all entries received and verified by Promoter during the Giveaway period. Winners will be notified by separate Facebook post, by a comment below a Facebook post, by email and by private message within 5 days of the closing date.

4. Prizes, Notification of winners, Delivery of prizes

The prizes are as follows:

• 1st prize: Black Diamond Impact crash pad (or another climbing equipment of similar value) plus a 1-year subscription of Topo Guru app
• 2nd prize: DMM Edge chalk bag (or another climbing equipment of similar value)
• 3rd prize: Black Diamond chalk and Red Chili brush (or another climbing equipment of similar value)

4.1 During the period of the Giveaway, the Promoter reserves the right to change the prizes - by notifying Entrants via TG Facebook page - and to substitute any prize with another of equivalent value.4.2 The prize is as stated and no cash or other alternatives will be offered. The prizes are not transferable. During the period of the Giveaway one Entrant is eligible only for one prize.
4.3 No later than the 5th working day after the winner has been chosen Promoter will notify the prize winner in a Facebook post/private message (the full name of the winner will be published), to which all Entrants expressly consent by participating in the Giveaway ("Notification"). The winner is obliged to confirm the receipt of the Notification in email or in a private Facebook message sent to the TG Site within two (2) days after receiving the Notification. If the winner does not confirm the Notification within the above deadline, the winner Entrant may be disqualified and the Promoter may nominate a reserve winner for the prize.
4.4 The prize will be sent by the Promoter to the winner via mail to the address provided by Entrant upon confirmation of the Notification within 30 days, and will also be notified by phone on the mobile number provided.
4.5 Promoter will exclude from the Giveaway an Entrant whose personal data provided in the confirmation of Notification is untrue, incomplete or incorrect, or the subscriber Entrant does not otherwise comply with the personal conditions set forth in these Terms and conditions. The Promoter shall not be liable for any misrepresentation made by the Entrant.

5. Data protection, privacy policy

5.1 Providing personal data during the Giveaway is voluntary. By participating in the Giveaway, Entrants acknowledge and expressly consent to
5.1.1 Promoter as data controller and data processor manage and process their personal data (full name, email address, Facebook ID, home address, telephone number) in connection with the given Giveaway for the purpose of contact and administration during the period of the Giveaway;
5.1.2 in the event of winning, their name will be published by the Promoter on the TG Facebook page exclusively in connection with the Giveaway, without any further condition or compensation;
5.1.3 By entering the Giveaway, they are indicating their agreement to be bound by these terms and conditions. All data is managed by Topo Guru Kft. as data controller.
5.2 Promoter guarantees that data management is carried out in all respects in compliance with the legal provisions in force. Promoter provides the Entrant at any time with the opportunity to request information about the handling of his/her personal data, and to request their cancellation or correction at [email protected].
5.3 Entrant acknowledges that it will result in disqualification from the Giveaway if he/she requests the cancellation of the necessary data for the execution of the Giveaway before the delivery of the prize.

6. Miscellaneous Terms

6.1 The Promoter shall not be liable for any incompleteness/error of the personal data provided by the Entrants (eg. misspelled name, wrong address, incorrect or untrue data, etc.), and for any failure or delay in the delivery of the prize outside Promoter's interests.
6.2 Promoter excludes its responsibility for the failure of the TG page for reasons beyond its control, during which time the Facebook page / website may not be used or restricted.
6.3 Promoter reserves the right to amend the Giveaway Terms and conditions at any time in justified cases. Promoter will publish the relevant information on the TG Facebook page, ensuring the same publicity as other announcements of the Giveaway.
